is in the public domain in the United States - it is in copyright
in the rest of the world.  Making it available on the World Wide
Web is in violation of that copyright.

We will be pleased to have a response from Project Gutenberg that

As per your request concerning ANTHEM, by Ayn Rand, we have done
exhaustive research over the years on this subject, and have not
found any indication that the copyright laws of one country will
have any force in any other country, even in cases of publishing
materials on the Internet or the World Wide Web.

In this particular case, we have gone out of our way, to request
and provide additional statements to protect any rights the book
might still have, and we would be only too happy to continue the
practice by including anything you would care to send for future
inclusion in this eBook.

Project Gutenberg has eBook servers only in the United States.

We should be more than happy to write a letter requesting ANTHEM
be deleted from sites in any country in which it is copyrighted,
or otherwise similarly protected, in conjuction with any efforts
you might be making.  Just let us know to whom to send them.

We will also be more than willing to contact a Project Gutenberg
of Canada representative, or Project Gutenberg of Australia, and
even Project Gutenberg of Europe, none of whom are under control

As of our research there is no case law to support your claim:
